Terms of Service

The short version

  • · You're buying real trading cards at published odds, every pack contains cards with real market value, and every box's contents are locked and provable before the first rip.
  • · Everything on the site runs on Sparks, our store credits, 100 Sparks per dollar. Sparks have no cash value, can't be withdrawn or exchanged for cash, and can't be sent to other users. Value leaves the shop exactly one way: having your cards shipped to you. There is no cash-out, and none is planned.
  • · Every card you pull can be sold back instantly for Sparks at 85% or more of market (a spike cap applies only to a card whose price jumped far above what you pulled it for — you can always ship that card instead to realize its full value), shipped home for a flat 499 Sparks per card (+500 Sparks per card to a Canadian address), or kept in your vault. Higher-value cards worth $100 and up ship fully insured and signature-required after a quick review, and carry a 5% insurance & handling fee on the card's value on top of the flat 499 Sparks. Shipping a card home may require you to verify your identity first — or you can wait out a short clearance window (up to about 120 days) instead.
  • · Unopened packs may be refunded at the price paid, at our discretion, through support.
  • · PackLab is a virtual card shop and entertainment product: every pack always contains its full count of real, market-priced cards, box structure and odds are disclosed and verifiable before you buy, and Sparks are closed-loop store credit with no cash-out.
  • · You must be 18 or older.
  • · We can refuse service, change prices and features, or wind things down at our discretion, but committed boxes never change, accepted orders are honored, and your paid value is always redeemable.

1. Who we are and what this is

These Terms of Service ("Terms") are an agreement between you and Tyler Mailman (d/b/a PackLab) ("we," "us"). We operate a VIRTUAL CARD SHOP, an online retail trading-card store with a buy-back desk. When you open a pack on our site, you receive specific, identified trading cards with ascertainable market value, drawn from a box whose complete contents were cryptographically committed before the box's first pack was opened. There are no empty slots: every pack contains its full count of real cards, every card has a market price, and you may convert any card back to Sparks at a published rate at any time. By creating an account you accept these Terms and our Privacy Policy.

1a. A retail product, by design

PackLab is a virtual card shop: a retail store selling sealed trading-card packs, the same product sold in hobby shops and big-box stores, opened online instead of at your kitchen table. Here is how it is built as retail: (a) every purchase delivers full consideration, a pack always contains its full, disclosed count of real, specific, market-priced trading cards; you can never open a pack and receive nothing; (b) each box's guaranteed structure (including its minimum-value headliner card) is disclosed before you buy, and each box's complete contents are cryptographically committed and publicly verifiable after it finishes; (c) every card can be converted back to Sparks instantly at the published flat rate or shipped to you as physical product, so your purchase remains redeemable for Sparks or a shipped card; and (d) Sparks are closed-loop store credit with no cash-out of any kind. Card market values fluctuate like any collectible; that is ordinary market risk inherent to trading cards everywhere. If a regulator, court, or platform requires changes to how we offer the service in a jurisdiction, we will comply. We do not market, describe, or operate this service as gambling, and you agree not to use it as a substitute for gambling.

1b. Trademark disclaimer

PackLab is not affiliated with, endorsed by, sponsored by, or associated with Nintendo, The Pokémon Company, Creatures Inc., GAME FREAK inc., or any other trademark holder mentioned on this platform. Pokémon and all related marks are trademarks of their respective owners.

1c. Virtual products

What you buy and pull on the service are VIRTUAL CARDS, digital collectibles recorded in your vault. A virtual card is a digital product; it confers no right to any physical card unless and until you redeem it for shipping under Section 7, at which point we source and mail the corresponding physical card. We reserve the right, at our sole discretion and to the fullest extent permitted by law, to modify, substitute, re-price, or remove any item, and to alter, suspend, or discontinue any feature of the service, at any time. Digital purchases, Sparks, and vaulted virtual cards have no cash value and no cash-out: value leaves the service only as shipped physical cards, or as Sparks where these Terms so provide, never as cash, and none is planned.

1e. Mystery Pack: an optional random-set pack

The Mystery Pack is an optional, provably-fair product. You open a PackLab Mystery Pack for a dynamic price in Sparks (from a 1,000-Sparks floor, shown before you open; or a free open credit granted through the referral program), and it awards you one real booster pack of a random live set, which you then rip normally like any other pack. A Mystery Pack always returns a real, market-priced booster: there is no outcome where you receive nothing. The set you get is selected provably fairly, weighted by set value, so cheaper boosters are common and expensive vintage sets are rare; on average an open returns a booster worth somewhat less than the open price, so like every pack it is entertainment and product, not a way to make money. The exact live odds for each value tier, the average return, and the store margin are shown on the Mystery Pack product page before you open, and are disclosed in the Fairness & Odds Disclosure (§9). The Mystery Pack is entirely optional and never required to use the service; we do not market or operate it as gambling.

2. Eligibility

You must be at least 18 years old — or the age of majority in your province or territory of residence, whichever is higher — and reside in a jurisdiction where use of the service is permitted. Creating an account, buying Sparks, and using the shop are OPEN INTERNATIONALLY, except where prohibited by applicable law or in countries or territories subject to U.S. sanctions; we do not geo-block access by country, and ensuring that your use of the service is lawful where you live is YOUR responsibility. Physical fulfillment is different: we ship cards and source code cards ONLY to United States and Canadian addresses, as described in Section 2a. You certify your age at signup. One account per person.

2a. International buyers

Anyone may create an account and buy Sparks from anywhere we lawfully operate, but PHYSICAL FULFILLMENT IS LIMITED TO THE UNITED STATES AND CANADA. If you are outside the United States and Canada you may still use every part of the service — deposit, rip, sell back, and vault — and by buying you acknowledge and agree that: (a) cards and code-card redemptions SHIP ONLY TO A UNITED STATES OR CANADIAN ADDRESS, and arranging delivery to such an address is YOUR responsibility, in the worst case by having a card forwarded on to yourself, at your own cost and risk; (b) Sparks are NON-REFUNDABLE TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHETHER OR NOT you are able to arrange United States or Canadian delivery — your value is not lost, because Sparks stay spendable on the service and every card you pull can be sold back for Sparks at the published rate; (c) you have READ THESE TERMS, the Refund Policy, and the Fairness & Odds Disclosure before buying; and (d) local law, customs duties, import taxes, and any carrier or forwarding restrictions where you live are YOUR responsibility, and we make NO REPRESENTATION that any card may lawfully be imported into your country. Nothing in this Section limits the rights you cannot waive by contract: your right to dispute a charge or chargeback with your card issuer, your right to a refund if we fail to deliver, your protection against unauthorized or fraudulent charges, or the non-waivable rights preserved in Section 13a.

3. Sparks: our store credits

Purchases on the service are made with Sparks, our closed-loop store credits, priced at 100 Sparks per U.S. dollar (1 Spark = 1¢); larger packages include bonus Sparks as disclosed at purchase, an account's first qualifying package purchase includes one free promotional booster pack (one per account, as disclosed at purchase), and we may grant other promotional Sparks and promotional packs (purchase bonuses, promo codes, daily gifts, referral rewards, and Sparks you earn by completing third-party offers, see Section 3a) that are subject to the same rules as anything else acquired on the service. Sparks are a limited, revocable license to acquire products and services on this site. Sparks: (a) are store credit for use only on this site; they are not cash, money, or legal tender, cannot be withdrawn or cashed out, and are not a bank deposit; (b) cannot be withdrawn, cashed out, or exchanged for cash, gift cards, cryptocurrency, or any other currency or cash equivalent; (c) cannot be transferred, gifted, or sold to any other user or third party, no transfer feature exists; (d) may be used only on this site, for pack purchases, fees, and other offerings we make available; (e) are final and non-refundable once purchased, to the maximum extent permitted by law and except where the law requires or as described in the Refund Policy (we may, at our discretion, refund unspent Sparks to the original payment method); this does not affect your right to dispute a charge or chargeback with your card issuer, your right to a refund if we fail to deliver, your protection against unauthorized or fraudulent charges, the refund of a minor's purchases under the Age & Eligibility and Privacy Policies, or the non-waivable rights in Section 13a; and (f) do not accrue interest or expire while your account is in good standing. We may decline a Sparks purchase when the amount purchased would take your balance above 25,000,000 Sparks ($250,000); buying resumes once you spend below the ceiling, and credits we owe or grant you, sell-backs, refunds, and promotional Sparks are never blocked by this ceiling, so you can always liquidate your vault in full. Card market values shown in dollars are price references from third-party market data; every amount you actually pay or receive on the service is denominated in Sparks.

3a. Promotions: referrals, the daily bonus, purchase bonuses, ETB bundles, partners, the first-deposit recovery offer, earned Sparks

We run several promotional programs; all promotional Sparks and promotional packs follow the same rules as anything else on the service (Section 3). (a) REFERRAL PROGRAM, when a person you invite through your personal link registers and makes their first Sparks purchase of $9.99 or more, we grant one free Mystery Pack open to EACH of you — the invited person and you, the referrer. A free open is a promotional credit redeemable on the Mystery Pack product (Terms §1e); it awards a real booster of a random live set at the published odds, follows all rules in Section 3, and has no cash value. One referral reward per side per invited person, ever, and the referrer's reward additionally requires the referrer to have made a qualifying Sparks purchase of their own. A fraud guard limits each referrer to 20 referral reward payouts per UTC day; a qualifying purchase past that limit is not lost, the reward is granted on the invited person's next qualifying purchase after the limit resets. Self-referrals, bulk account creation, and other referral abuse are prohibited, and we may withhold or reverse rewards obtained that way and suspend the accounts involved. (b) DAILY BONUS, eligible accounts may claim one free daily bonus per UTC day: a fixed amount of Sparks, the same every day, disclosed on the wallet page. Eligibility requires all of: a verified email address, a qualifying Sparks purchase within the active-rewards window (the recent-purchase window shown on your wallet and Rewards pages), and an account older than 24 hours. The daily bonus is a fixed, house-funded promotional credit, not a random draw; the reward is closed-loop Sparks with no cash value, is not redeemable for cash, and follows all rules in Section 3. (c) FIRST-PURCHASE PACKAGE PACK, an account's first qualifying Sparks package purchase ($25 and up) includes one free promotional booster pack, one per account, at the tier disclosed on the purchase page. (d) ELITE TRAINER BUNDLES, an ETB bundle consists of the same number of booster packs as the corresponding physical Elite Trainer Box (disclosed on the product page; the count is verified against the physical product's published contents), at a bundle discount, plus the same promotional card that physical Elite Trainer Box ships with (when that product includes one) minted into your vault at its live market value, and a disclosed Sparks credit standing in for the physical accessories. For products whose real Elite Trainer Box includes NO promo card, the bonus card is instead our OWN pick from that set, a popular single we chose, clearly labeled on the product page as our take and NOT the official ETB promo, minted into your vault at its live market value like any other card. Where a physical box includes additional assorted packs beyond its own expansion (e.g. Celebrations), the bundle includes and charges for only the expansion's own packs, as disclosed on the product page. The "sealed market" figure shown beside a bundle is a live third-party market-price reference for the sealed physical product; it is informational and is not a promise that any card or product holds value. (e) PARTNER PROGRAM, approved creators earn promotional Sparks equal to a disclosed percentage (currently 5%) of the PAID amount of Sparks purchases made by users who registered through their partner code; commission is never paid on bonus or promotional Sparks, is subject to per-partner daily and per-referred-account lifetime caps, and is paid in closed-loop Sparks that follow all rules in Section 3 (no cash value, no withdrawal). Partner status requires an application and approval, may be suspended or revoked for fraud, self-referral, misleading promotion, or breach of these Terms (Sparks already earned are not confiscated except in cases of fraud), and a registration is attributed to at most ONE program, a partner code and a friend referral never both pay for the same signup. We may modify or end any promotion prospectively at any time; rewards already granted are never clawed back except in cases of fraud or abuse. (f) ONE PER PERSON. Promotional Sparks, bonus packs, promo codes, daily gifts, and referral rewards are offered at our discretion and are limited to one per person, not merely one per account; referral rewards require inviting a different, genuine person, so self-referrals and referrals between accounts controlled by the same person or household do not qualify. To enforce these limits and prevent abuse, we may verify eligibility and may withhold, reduce, void, reverse, or refuse promotional credits, and may suspend accounts, where we reasonably determine a promotion has been abused through duplicate or multiple accounts, self-referral, or misrepresentation; for this purpose we may treat accounts that appear to belong to the same person as a single account. These determinations are at our reasonable discretion and do not affect the underlying purchase you made with real money. (g) FIRST-DEPOSIT RECOVERY OFFER, an account that has verified its email but has never made a Sparks purchase may be shown, at most once and only as it is about to leave the site, a one-time offer to match its first deposit with bonus Sparks: a disclosed percentage of that qualifying deposit, up to a disclosed maximum, added as promotional Sparks when the deposit is credited. The offer is one per person under (f), applies only to a first qualifying Sparks purchase at or above the disclosed minimum, and STACKS ON TOP OF — it does not replace — the first-purchase free pack in (c) or any package bonus. If you dismiss it or leave without taking it, it does not carry over, and the bonus applies only if the qualifying deposit is completed promptly, during the same visit the offer is shown. The match is house-funded promotional Sparks and follows all rules in Section 3 (no cash value, no withdrawal, non-transferable). If the funding deposit is later refunded or charged back, the deposit is reversed as set out in the Refund Policy, and the promotional bonus Sparks — like every other bonus on the service — are not separately refundable and have no cash value; the one-time offer, once used, is not reinstated. This offer is optional, promotional, and never required to use the service; we may modify or end it prospectively at any time, and rewards already granted are not clawed back except in cases of fraud or abuse. (h) EARNED SPARKS (FREE-SPARKS OFFERS), a signed-in account belonging to a person 18 or older may earn promotional Sparks by completing offers, surveys, or similar tasks presented through our third-party offer partners (currently Lootably). Earned Sparks are a house-honored loyalty/rewards credit: a FIXED, deterministic amount, disclosed before you start a given offer and credited when the offer partner confirms your completion. They are NOT a prize, a draw, or a sweepstakes entry, there is no element of chance in the reward, and completing an offer is not a purchase. Earned Sparks are closed-loop store credit and follow all rules in Section 3 (no cash value, cannot be withdrawn or exchanged for cash, non-transferable). Earning is a promotional reward, NOT a qualifying Sparks purchase: it does not count as a deposit and does not unlock or count toward any purchase-gated benefit, including the first-purchase free pack (c), the daily bonus's recent-purchase requirement (b), the first-deposit recovery match (g), VIP tier progress (Section 3b), or referral and partner qualification. Earned Sparks are one per person under (f), are subject to per-person daily and lifetime earning limits, are limited to signed-in accounts, and are offered at our discretion. Because the reward is funded by a third-party network, it is REVERSIBLE: if the offer partner or its network later reverses, charges back, invalidates, or declines a completion (for example for a reversed survey, a clawed-back conversion, or fraud), the corresponding earned Sparks are removed as set out in the Refund Policy; this reflects that the underlying reward was not honored and is not otherwise a penalty on your account. We may verify eligibility, withhold, reduce, void, or reverse earned Sparks, and suspend accounts, where we reasonably determine the program has been abused (duplicate accounts, falsified completions, automation, or misrepresentation). Earning is optional, promotional, and never required to use the service; we may modify or end it prospectively at any time, and Sparks already earned are not clawed back except on a network reversal or chargeback, or in cases of fraud or abuse.

3b. VIP rewards and loyalty tiers

We run a house-funded VIP rewards program that recognizes how much cash you pay for Sparks in a calendar month. Perks may include a daily Sparks claim, one-time rank-up rewards when you first reach a tier, and a boosted sell-back (buyback) rate, as shown on the Rewards page. All VIP perks are promotional, house-funded Sparks or benefits: they have NO CASH VALUE, are NON-TRANSFERABLE, and create NO PROPERTY RIGHT, VESTED BENEFIT, OR GUARANTEE OF FUTURE REWARDS. Your tier is measured by qualifying monthly cash spend and, as disclosed up front on the Rewards page, RESETS ON THE FIRST OF EACH CALENDAR MONTH, tier status does not carry over. Your tier is measured by the net cash you pay for Sparks during the month; spending Sparks you already hold does not raise your tier. We may add, modify, reduce, suspend, or discontinue any perk, tier, threshold, or the program as a whole, prospectively, at any time and at our sole discretion. What we will not do is claw back what you have already earned: rewards already granted, and rank-up rewards you have already qualified for but not yet claimed, are honored under the terms in force when you earned them.

3c. Saved cards & one-tap top-ups

You may save a card to buy Sparks in one tap, so you don't re-enter card details each time. This is optional and entirely under your control. SAVED-CARD AUTHORIZATION: when you save a card, you authorize PackLab, through our payment processor Stripe, to store that card and to charge it for the Sparks top-ups you initiate — (a) TIMING & FREQUENCY: only when YOU tap to buy, on demand and unscheduled; this is not a subscription and we place no automatic or recurring charges; (b) AMOUNT: only the amount you select and confirm on the one-tap confirmation screen before the charge; (c) HOW IT'S STORED: the card is stored by Stripe, a PCI-compliant processor; PackLab never receives or stores your full card number — only the card's brand, last four digits, and expiry, for display, and an opaque fingerprint for fraud prevention (Privacy §1); and (d) CANCELLATION: you can remove a saved card at any time from your wallet, which immediately ends this authorization for that card; we record the date, terms version, and device of the authorization you gave, as your issuer's card-network rules require. A one-tap top-up is a Sparks purchase like any other and is FINAL AND NON-REFUNDABLE to the maximum extent permitted by law once the Sparks are credited (Section 3(e), Refund Policy), except that your Sparks stay spendable, never expire while your account is active, and every card sells back for Sparks. Nothing here limits the non-waivable rights preserved in Section 13a (your right to dispute a charge with your issuer, a refund if we fail to deliver, or protection from unauthorized charges). We may decline a top-up that would take your balance past the ⚡25,000,000 balance ceiling. Saved cards and one-tap top-ups are offered on the website; in our mobile apps, purchases continue through the secure external checkout.

4. Buying and opening packs

Packs are purchased with Sparks, and purchases are final at the moment of purchase, except as described in the Refund Policy (unopened packs may be refunded in Sparks at the price paid, at our discretion, via support). Packs are sold per set and are not tied to a particular box until you open them; when you open a pack, it draws the next slot of the current live box's pre-committed shuffle. Published odds and the guaranteed box structure for each product appear on its product page and in the Fairness & Odds Disclosure. Pack prices are set automatically from live market data and track the market in both directions, so they can rise or fall at any time, including while a box is live; the price you pay is always the price shown at checkout, and any refund returns exactly what you paid.

5. Your vault: cards as claims

Cards you keep are recorded in your vault as claims to the identified cards. We do not keep most cards warehoused in inventory — when you redeem a card for shipping, we source that exact card (same name, set, number) to order, which adds a sourcing window before it ships. We may source a card in different ways depending on the card and its availability: for example, buying it from a major marketplace (such as TCGplayer) for shipment directly to you, ordering it to our own facility to receive and then mail to you, or filling it from cards we obtain locally. How we source a card, together with its rarity and availability, affects how long sourcing takes (see Section 7). We source the best condition available — usually Near Mint; for older or scarce sets where Near Mint cannot be sourced, we ship the best obtainable grade (which may be Lightly, Moderately, or occasionally Heavily Played) rather than cancelling your shipment. If a card is obtainable in any condition, it is shippable here. Until redemption or sale-back, your vault entry is a claim against us for that card or its cash-value treatment under these Terms.

6. Instant sell-back

You may sell any vaulted card back to us instantly, paid in Sparks, at a rate of at least 85% of the card's live market value (VIP tiers earn a higher rate, see Section 3b). One limit protects against extreme, temporary price spikes: if a card's market price has jumped far above the value at which you obtained it, an instant sell-back is calculated on a CAPPED value — the value when you obtained the card plus the greater of $25 or 10% — instead of the spiked price. This never reduces a normal sell-back; it applies only to a card trading well above its pull value, and even then you can always redeem that card for shipping (Section 7) to receive its full market value as a physical card, or simply hold it in your vault. Live market value comes from continuously refreshed third-party market data; quotes are valid for 60 seconds.

6a. Cancellations and refunds: paid at full value

On any cancellation or refund we pay 100% of a card's live market value in Sparks, with NO cap — the spike cap in Section 6 applies only to a voluntary instant sell-back you choose, and never to a refund. (Instant voluntary sell-back is at least 85%, subject to that Section 6 spike cap.) If we accept a shipment and cannot source the card in any condition, we credit 100% of the card's live market value in Sparks, plus the per-card shipping fee you paid back. Live market value comes from continuously refreshed third-party market data and updates automatically.

6b. Marketplace: buying a single

The Marketplace lets you buy a specific virtual card outright instead of ripping for it. The price is the card's live third-party market value plus a convenience store markup (shown in full in Sparks at checkout before you confirm, and larger in percentage terms on cheaper cards); the amount you pay is the amount shown. Marketplace purchases are made with Sparks only and are FINAL at the moment of purchase. What you buy is a virtual card that lands in your vault with the same rights as any other vaulted card, keep it, sell it back instantly at the published rate, or redeem it for shipping under Section 7.

7. Redemptions: how value leaves the site

Everything that exits the system is reviewed by a person before it goes out. (a) CARD SHIPPING, the redemption path: each card ships individually for a flat 499 Sparks; cards shipped to a CANADIAN address carry an additional 500 Sparks per card to cover domestic Canadian postage. HIGH-VALUE CARDS (live market value of $100 / 10,000 Sparks and up) SHIP FULLY INSURED and REQUIRE YOUR SIGNATURE on delivery, and carry a 5% insurance & handling fee on the card's live market value on top of the flat 499 Sparks; if such a card is lost or damaged in transit we credit 100% of its live market value in Sparks plus the fee back (this remedy is not subject to the Section 12 liability cap). To protect against fraud, before we ship ANY card we MAY require you to complete IDENTITY VERIFICATION (a government-issued ID and a selfie, processed by our verification provider Stripe). Until you verify (or your recent payments have already passed their card-network dispute window), we simply will not ship that card — but it stays in your vault and remains fully yours to keep or sell back in the meantime; nothing is charged. As an alternative to verifying, you may CHOOSE to place the card in a clearance hold (a "box"): it locks in your vault — it cannot be shipped, sold back, or otherwise used — until your recent payments pass their dispute window (up to approximately 120 days), after which it automatically returns to your vault and becomes redeemable without identity verification. Approved shipments are sourced to order and typically ship within 1 to 14 days, depending on how the card is sourced and its rarity and availability — we do not keep cards warehoused at all times. Once we mail an item, it typically arrives within 2 to 7 days. When we source a card to our own facility before sending it to you, that leg typically takes about 3 to 12 days to reach us and we then mail it out to you within 48 hours of receiving it; any tracking number we give you is for the OUTBOUND shipment to your address only — we do not share tracking for a card's movement to us. We usually provide a tracking number, and some lower-value single cards may ship in a plain envelope without tracking; high-value cards ($100 and up) always ship tracked, insured, and signature-required. Cards ship in the best condition we can source — usually Near Mint, though older sets may ship a played grade (see Section 5); if we cannot source your card in any condition, we credit 100% of its live market value in Sparks plus the full per-card fee you paid back. We may choose the sourcing, packaging, and shipping method for each card, and we may change these methods and timeframes; any change applies to shipments going forward. (b) CODE CARDS: online code cards are redeemed by email for a 249 Sparks processing fee, available while the set's code cards are purchasable on third-party marketplaces (checked automatically; each code is sourced on redemption); the physical code card is never mailed. No other redemption exists: we do not offer, and do not plan to offer, redemption for cash, gift cards, prepaid cards, cryptocurrency, or any other cash equivalent. We may decline any redemption that fails review; declined redemptions are refunded in full, including fees.

8. Provable fairness

Box contents are committed by published SHA-256 fingerprints before any pack from that box is opened; the shuffle derives from our committed seed and a public drand randomness beacon; complete box data is published when the box's last pack is opened. The full method is described in the Fairness & Odds Disclosure, which is incorporated into these Terms. Where box data verifies against the published commitments, the published draw results are conclusive as to pack contents.

9. Pricing basis

Card values shown on the service are drawn from third-party market data (currently TCGplayer market prices via the pokemontcg.io API) refreshed on a continuous schedule. Values move with the market. Market values are displayed in U.S. dollars as a price reference; every amount you pay or receive on the service is in Sparks at the 1 Spark = 1¢ reference rate. Where a card lacks reliable market data, we may temporarily hold shipping availability while data refreshes (sell-backs stay available at the standard 85%), or set a house price for house-issued items (such as code cards).

10. Dormant accounts and unclaimed property

If your account holds Sparks or vaulted cards and has no login or transaction for 3 years (or the period your state's or, where applicable, your province's or territory's unclaimed-property law provides, whichever applies), we will attempt to contact you at your registered email. Value that remains unclaimed after the statutory period will be reported and remitted as unclaimed property to the applicable state or provincial authority, where and to the extent the law requires. Vaulted cards may be liquidated at 100% of live market value into Sparks for this purpose after notice.

11. Acceptable use

You agree not to: use the service under 18 or from an excluded jurisdiction; create multiple accounts; use bots or automation to buy, open, or sell; exploit pricing or data errors; use the service to launder money or evade sanctions; or interfere with the fairness mechanism. We may suspend accounts, hold redemptions pending investigation, and reverse transactions that violate these Terms. Sparks purchased in violation may be refunded to the payment source rather than redeemed. Promotional Sparks earned through third-party offers (Section 3a(h)) are reversible and may be removed if the offer network reverses, charges back, or invalidates the underlying completion, or where the earning program has been abused.

11a. Our rights

We reserve the right, at our sole discretion and to the fullest extent permitted by law, to: refuse, suspend, or terminate service to any account, with or without notice, for any lawful reason; cancel or reverse any order or transaction we reasonably believe involves error, fraud, abuse, or a violation of these Terms; change prices, products, odds structures, features, fees, and policies prospectively at any time; and modify, suspend, or discontinue all or part of the service. Two things never change retroactively: a box that has been cryptographically committed stays exactly as committed, and an order we have accepted is honored under the terms in force when you placed it. If we suspend or close your account (or shut the service down), your paid value survives, remaining Sparks and vaulted cards are redeemed through the normal redemption paths, less amounts connected to fraud or chargebacks.

12. Disclaimers and limitation of liability

The service is provided "as is." We do not warrant uninterrupted operation. Cards are collectibles; their prices can fall as well as rise, and nothing on the service is investment advice. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF $100 OR THE AMOUNTS YOU PAID US IN THE SIX MONTHS BEFORE THE CLAIM AROSE; WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. This cap does NOT limit the specific redemption remedies we commit to in Sections 6a and 7 — including our commitment to credit 100% of a card's live market value in Sparks (plus the fee back) if a shipment is unsourceable or if an insured, signature-required high-value card is lost or damaged in transit — which are honored in full regardless of this limit.

13. Disputes: arbitration and class waiver

Any dispute arising out of these Terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, seated in the State of Maine, except small-claims matters and injunctive relief for IP violations. YOU AND WE WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION. You may opt out of arbitration within 30 days of account creation by emailing support@packlab.gg; opting out does not affect the rest of these Terms.

13a. Governing law

These Terms and any dispute arising out of them or the service are governed by the laws of the State of Maine, without regard to its conflict-of-law rules, and by applicable U.S. federal law. Where a consumer-protection law of your state of residence grants rights that cannot be waived by contract, those rights are unaffected by this section.

13b. Communications

By creating an account you agree that we may contact you electronically at the email address on your account. TRANSACTIONAL AND SERVICE messages (receipts, email verification, password resets, shipment and redemption updates, security and policy notices) are part of the service and continue while your account is open. We may also send PROMOTIONAL messages about offers, rewards, and new sets. Every promotional message is identified as promotional, includes our postal address, and carries a working one-click unsubscribe link; you may also opt out at any time from Email preferences in your account settings. Opting out of promotional email never affects transactional and service messages. We do not sell or rent your email address.

14. Changes, termination, contact

We may update these Terms at any time and at our sole discretion. Changes take effect when posted here, and the "Updated" date at the top of this document is the notice of record; continued use of the service after that constitutes acceptance. We are not required to give advance or individual notice of a change, except where applicable law requires it. If a change materially reduces rights you already hold, we will make reasonable efforts to tell you, by email, in the app, or on the site, before it applies to you. Two things never change retroactively regardless: a box that has been cryptographically committed stays exactly as committed, and an order we have accepted is honored under the terms in force when you placed it. You can manage your own account security from your account settings: reset a forgotten password, change your password or email address (an email change requires re-verifying the new address), connect or disconnect Google sign-in, and sign out of every device at once ("sign out everywhere"). You may close your account at any time; on closure we will redeem your remaining Sparks and vault through the normal redemption paths (fees apply).
